Carrying a Concealed / Loaded Firearm

A family member was charged with Penal Code Sections 25400(a) (2)/(c) (7) [Carrying Concealed Firearm] and 25850(a)/(c) (7) [Carry Loaded Firearm in Public]. Initially she was facing up to three years in prison as the case was filed as a felony. Later the case was reduced to a Misdemeanor. I hired attorney Will Bruzzo to represent my family member after I reviewed him on-line and spoke with him (I have a legal background). I apprised Mr. Bruzzo of the mental health situation my family member was contending with. Notably, the mental health problem was clear to see from the police report. Mr. Bruzzo met with the District Attorney and came up with an informal plan of psychological care for her. After about 6 months of care with proof, the District Attorney DISMISSED the case. She never did jail time and she has no conviction. This is a very good result seeing as the District Attorney could have easily proven the case and given the current societal anxiety about guns. However, this disposition also reflected the fact my family member was less a criminal and more simply suffering from untreated mental illness. I was arrested for carrying a loaded weapon in public in violation of penal code section 25850(a)/(c)(6) as a felony. I was facing up to three years in prison for this offense. I was arrested for a violation of Penal Code Sections 12025(a) (1) [Carrying a Concealed Weapon in a Vehicle], 12031(a) [Carrying a Loaded Weapon in a Vehicle] and 538(b) (2) [impersonating an officer]. I had several weapons in my vehicle with ammunition-most of my weapons were properly stored in my vehicle but a few were not. All the weapons pertain to my being in the private security business. I also had other very expensive items that I needed for my job. I hired Attorney William W. When the police stopped me the weapon was in the vehicle with me and I also had bullets in the vehicle but they were not in the weapon. I was looking at up to one year in jail for this matter. I had to plea guilty to carrying a loaded weapon because I had confessed it to a police officer. For this conviction I was sentenced to 6 months of jail; however, Mr. Bruzzo requested a stay on the jail sentence which gave me time to apply for HOME CONFINEMENT. Although it is very rare for someone with my charges to qualify for home confinement Mr. Bruzzo spoke personally with the people in charge of the home confinement program. In the end they gave me 6-months of home confinement instead of jail. I truly believe that Mr. Bruzzo’s knowledge of the law, the District Attorney and the court in general was critical to the positive outcome of my case.
