If someone takes something from a store without planning the theft in an impulsive manner, then the person can be charged with Petty Theft. If the value of the property taken is $50.00 or less then the person may be charged with an infraction at the discretion of the prosecutor under Penal Code Section 490.1. An infraction is like a speeding ticket which is also an infraction and is not considered a criminal conviction.
