Warrants

About 30 years ago when I was 18 years old I committed a Robbery, Penal Code Section 211 with a weapon in Orange County, California. I managed to avoid prison and I was put on probation for three years. However, after two years I left the state without permission from my probation officer and a felony warrant issued for my arrest. I got in trouble again just a year or so later and I did a stint in prison in another state; after that I decided I needed to turn my life around so I found a job, got married and raised a family. For 30 years I avoided any new legal problems. However, it was all very stressful knowing that even a traffic stop could result in the authorities learning of my warrant and returning me to California to serve time. After many years of worrying about this I consulted with my family and I decided to do something about it. I ended up hiring Attorney Will Bruzzo who has been able to recall warrants for other clients without them doing additional jail time; he has also been able to do it without clients appearing in court. In November of 2013 I stole items from a roommate and I was charged with Residential Burglary (Penal Code Section 459-460(a), Grand Theft (Penal Code Section 487(a) and Receiving Stolen Property (Penal Code Section 496 (a). I was also charged with drug offenses for Possession of Methamphetamine (Health and Safety Code 11377(a) and Possession of Paraphernalia (Health and Safety Code Section 11364.1(a). These charges were all felonies (except for the Paraphernalia charge) and I was looking at a maximum of 5 years in prison for these offenses. [At the time of my arrest] I was having a lot of problems including drug addiction and I fled the state while the case was pending [the case became a felony warrant]. 7 years later I was picked up on the warrant out of state and extradited back to California. I had six arrest warrants to include two felony arrest warrants for Possession of a Controlled Substance [Health and Safely Code Sections 11350(a), 11377(a), 11550(a)], Possession of Drug Paraphernalia [Health and Safety Code Section 11364(a)], Drunk Driving [Vehicle Code 23152(a)] and presenting false ID to a Police Officer [Penal Code Section 148.9]. A friend of mine suffers from mental health and substance abuse issues. While she was in Orange County, California she picked up 5 (five) misdemeanor cases. I committed a series of crimes in Orange County, California which got me convicted of felonies and placed on probation. I did well on probation for about two of the three years and I then was put on unsupervised formal probation. I had a felony warrant for an old probation violation out of Orange County, California from almost 20 years previous. While I no longer lived in California it was very unnerving to go through life with a warrant hanging over my head. I was sentenced to 90 days in Jail on a misdemeanor matter. I failed to report to the Jail as ordered and a WARRANT went out for my arrest. I appeared on the warrant [without a lawyer] and I was taken into custody and bailed out. I was consulting with Mr. Will Bruzzo during this time and [eventually] hired him to represent me on this probation violation. Mr. Bruzzo encouraged me to get into a drug program. I was charged with a third drunk driving offense two years after being convicted of two previous drunk driving offenses [Vehicle Code Section 23152(a), 23152(b)]. A third drunk driving offense is a minimum of 120 days jail. After appearing in court once I did not appear again and a warrant went out for my arrest. I found a new job and went through a background check with the new employer. At that time they informed me I had a felony warrant for Penal Code Section 261.5, Unlawful Intercourse (Statutory Rape). I was arrested for possession of [controlled substance] paraphernalia [Health and Safety Code (HS) 11364.1(a)] and given a date to appear; then just a few weeks later I was once again arrested for Possession of [controlled substance] paraphernalia [Health and Safety Code (HS) 11364.1(a). I failed to appear for either court date. To compound matters I was on probation for Driving on a Suspended License [Vehicle Code Section 14601.5]. I recently learned that I had a felony WARRANT for my arrest out of Orange County, California for an incident that had occurred many years before. The District Attorney had charged me with a violation of penal code section 476, Bad Checks, a felony; this crime carries a maximum punishment of three years in state prison. I was the subject of a Domestic Violence Restraining Order which limited me to only “peaceful Contact” with my former wife; later, I was charged with violating that protective order under Penal Code Section 273.6(a) when I sent angry text messages which contained obscenity to her. The police were able to get the text messages and I was charged. If I had been convicted of this charge I would have to complete a 52 domestic violence program and be on three years of probation. I was charged with misdemeanor possession of a controlled substance, and for being under the influence of it, a violation of Health and Safety Code section 11550(a) [H&S 11550(a)].
