A Petty Theft is punishable by a fine of $1000.00 or 6 months of jail or both. It is very unusual for anyone accused of this crime to do any jail if they are well represented by a lawyer.
A Petty Theft Misdemeanor can be reduced to an infraction (Penal Code Section 490.1) if the value of the Property is less then $50.00 and the offender has no prior record. However, sometimes a skillful attorney can get an infraction for a Defendant even if the value of the property exceeds $50.00.
