I was involved in a fight in Orange County where basically I thought these two guys were about to hit me so I hit them first, one time each. One of the guys hit his head on the concrete floor when he went down and cracked his head open- he ended up being hospitalized and he went into a coma although he eventually fully recovered. It was my belief from the beginning that I had been acting in self defense even though I had hit the guys first. I explained it all to the police. Despite that I was arrested, bail was set and I was eventually charged by the Orange County District Attorney with Battery with Serious Bodily Injury (Penal Code Section 243(d)) and Aggravated Assault with Force Likely to Produce Great Bodily Injury ( Penal Code Section 245(a)(1)); in addition I was facing two enhancements one for Inflicting Great Bodily Injury (Penal Code Section 12022.7(a)) and another for Inflicting Great Bodily Injury which led to the person becoming comatose (Penal Code Section 12022.7(b)). I was facing 13 years of prison for these offenses. These offenses are considered strike offenses. Also, I had been previously convicted of a misdemeanor charge for an altercation a few years previous.
